1. About QUSHi
QUSHi (the “App” and “Website”) is an educational platform for simulated trading with virtual coins. Users can place simulated orders (buy, sell, short-sell, and cover), track performance on leaderboards, and access video tutorials and community features. “QUSHi”, “we”, “us”, and “our” refer to the operator of the App and Website. 2. Acceptance of Terms
By creating an account, accessing, or using QUSHi, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use QUSHi.
3. Eligibility; Accounts
- You must be at least 16 years old, or the minimum age required by local law, to use QUSHi. If you are under the age of majority in your jurisdiction, you must have parental/guardian consent.
- You are responsible for your account credentials and all activity under your account. Notify us immediately of any unauthorized use.
4. Virtual Coins and Simulated Trading
- All trading within QUSHi uses virtual coins for educational purposes only. Virtual coins have no monetary value, are not redeemable or exchangeable for currency or goods, and do not represent any property right.
- We may issue, adjust, or reset virtual coin balances, portfolios, and positions (including as part of feature changes, season resets, anti-abuse actions, or maintenance).
- Orders (buy/sell/short/cover) and fills are simulated. Market data, delays, rounding, or execution rules may differ from real-world markets.
- QUSHi does not facilitate real-money trading and does not provide brokerage, execution, or custody services.
5. Leaderboards, Badges, and Fair Play
- Leaderboards, rankings, badges, and similar features are for learning and community engagement. They do not reflect real investment performance.
- Any attempt to game results (including coordinated or artificial activity, wash trading within the simulation, bots, or exploiting bugs) is prohibited and may lead to resets, penalties, or account termination.
- We may change leaderboard algorithms, eligibility, or visibility at any time.
6. Educational Content; No Financial Advice
- Videos, tutorials, posts, and any information on QUSHi are for educational purposes only and do not constitute investment, financial, legal, or tax advice.
- You are solely responsible for any decisions made outside the App. Consult a qualified professional before making real-world investment decisions.
7. Community and Acceptable Use
- Be respectful. Do not post content that is unlawful, infringing, misleading, harassing, hateful, abusive, obscene, or otherwise inappropriate.
- Do not impersonate others, spam, scrape, reverse engineer, interfere with service operation, or upload malware.
- We may remove content or suspend/terminate accounts for violations at our discretion.
8. User Content and License
- You retain ownership of content you submit (e.g., posts, comments, profile info). By submitting content, you grant QUSHi a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify, create derivative works (e.g., formatting), and distribute your content for operating and improving the service.
- Do not submit content you don’t have rights to or that infringes others’ rights.
9. Intellectual Property
The App, Website, code, design, logos, and other materials are owned by QUSHi or its licensors and are protected by law. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works from our materials.
10. License to Use the App
Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to access and use QUSHi for personal, non-commercial, educational purposes.
11. Privacy and Cookies
We process personal data as described in our Privacy Policy. We use cookies and similar technologies. You can manage consent via the Cookie Preferences link below or the banner, where available.
12. Third-Party Services and Links
QUSHi may integrate third-party services (e.g., analytics, content delivery, social media) or link to external sites. We are not responsible for their content, availability, or practices. Your use of third-party services may be subject to their terms and policies.
13. Availability; Changes
We may update, suspend, or discontinue any part of QUSHi (including features like leaderboards or tutorials) at any time. We may also update these Terms. Continued use after changes means you accept the updated Terms.
14. Termination
We may suspend or terminate access for any violation of these Terms, suspected fraud/abuse, or risk to users or the service. You may stop using QUSHi at any time.
15. Disclaimers
- THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- EDUCATIONAL RESULTS, RANKINGS, OR SIMULATED PERFORMANCE DO NOT PREDICT REAL-WORLD OUTCOMES.
16. Limitation of Liability
To the maximum extent permitted by law, QUSHi will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability for all claims will not exceed the greater of (a) the amounts you paid to us in the 12 months before the claim or (b) USD 100.
17. Indemnification
You agree to indemnify and hold harmless QUSHi and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.
18. Governing Law; Disputes
These Terms are governed by the laws applicable in your place of residence or, if specified by QUSHi, the laws of the jurisdiction of our principal establishment, without regard to conflict of laws principles. Any disputes will be resolved in the competent courts of that jurisdiction unless mandatory law provides otherwise.
