QUSHi, the “App,” “Website,” and “Service” are operated by QUSHi, LLC, a Florida limited liability company. In these Terms, “QUSHi,” “we,” “us,” and “our” mean QUSHi, LLC. QUSHi is an educational platform for simulated trading, league play, leaderboards, community content, competitions, and related features, available via a website, mobile app, or other digital experiences. QUSHi is not a broker, dealer, exchange, investment adviser, bank, custodian, or financial institution. QUSHi does not provide real money trading, brokerage services, trade execution, investment advice, legal advice, tax advice, or financial advice.
Our Privacy Policy is available on the App’s download or landing page in the App Store, inside the App’s Settings menu, and on the Website. We provide notice of the personal information we collect and how we use it at or before the point of collection.
You cannot create an account without first affirmatively clicking “I Agree” to these Terms and our Privacy Policy. By clicking “I Agree,” you acknowledge that you have had the opportunity to review these Terms, that you understand them, and that you are entering into a binding agreement. If you do not agree, do not create an account or use QUSHi.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example, in-app or by email. Your continued use of QUSHi after the updated Terms take effect constitutes your acceptance of the updated Terms.
You must be at least 16 years old to create or use a standard QUSHi account, unless a higher age is required by the laws where you live. At signup, we may require you to confirm your age. If you provide information showing you are under 16, you may not create or use a standard account, and we may block, suspend, or close it. If you are under the age of majority in your jurisdiction, you may use QUSHi only with the consent of a parent or legal guardian.
QUSHi is not intended for children under 13, and users under 13 may not create an account or use the Service. If we learn we have collected personal information from a user under 13, we may close the account and delete the information as required by law.
You must be at least 18 years old to enter skill-based Cash Games, prize competitions, or any feature involving real cash prizes. Before granting access to those features, we may require proof of date of birth, identity, location, tax status, an affidavit, a release, or other eligibility verification. Users under 18 may not enter a skill-based Cash Game, reserve a spot, appear on a Cash Game roster, become prize eligible, or receive a cash prize.
We may refuse access, suspend or close accounts, withhold prizes, or require additional verification if we believe a user does not meet these requirements.
You are responsible for your account credentials and all activity under your account. You agree to provide accurate information and keep it current. You may not create an account using false information, impersonate another person, sell or transfer your account, or allow another person to use it.
Notify us immediately at contact@qushi.io if you believe your account has been accessed without authorization. We may require additional verification before allowing access to certain features, competitions, prizes, account changes, or data requests.
All trading activity on QUSHi is simulated and for educational purposes only. Simulated orders, including buy, sell, short, and cover orders, positions, fills, gains, losses, balances, returns, drawdowns, and rankings, do not represent real investment performance and do not predict real-world results.
No real securities, crypto assets, currencies, commodities, derivatives, or other financial instruments are bought, sold, borrowed, lent, held, custodied, transferred, or traded through QUSHi. We do not send brokerage orders, execute or clear trades, or custody assets.
QUSHi uses virtual cash, also called virtual balances, as the simulated currency for placing simulated trades and tracking simulated performance. Separately, QUSHi may offer QUSHi Coins, a rewards token used for recognition, perks, achievements, or other platform features.
Neither virtual cash nor QUSHi Coins is real money. They have no cash value. They are not money, property, securities, crypto assets, stored value, gift cards, payment instruments, or financial accounts, and they are not redeemable, withdrawable, transferable, or exchangeable for anything of monetary value unless we expressly state otherwise in a separate written program.
We may issue, adjust, expire, revoke, reset, or remove virtual cash, virtual balances, QUSHi Coins, portfolios, positions, rankings, badges, or rewards at any time, including for maintenance, product changes, season resets, abuse prevention, error correction, legal compliance, or fair play.
QUSHi may use market data, pricing feeds, charts, or quotes from third-party providers. Market data may be delayed, incomplete, unavailable, inaccurate, rounded, or different from real markets. Simulated fills may not match real-world fills, and QUSHi may use its own simulation rules for order types, liquidity, spreads, short selling, price movement, trading hours, halts, corporate actions, volatility, and rejected orders.
You may not copy, scrape, redistribute, resell, or commercially use market data, charts, prices, or other data from QUSHi unless we expressly permit it in writing.
Leaderboards, rankings, profile records, badges, win rates, profit factor, return percentages, drawdowns, and other performance metrics are part of the simulated QUSHi experience. They are for learning, competition, and community engagement. They are not investment records, brokerage statements, audited results, or proof of real-world trading ability, nor do they predict real-world outcomes.
Any attempt to manipulate results, including coordinated or artificial activity, wash trading within the simulation, bots, multiple or fake accounts, or exploiting bugs, is prohibited and may lead to resets, removal of badges or rankings, penalties, or account termination. We may change, correct, hide, reset, recalculate, or restrict leaderboard algorithms, badge criteria, eligibility, ranking formulas, or visibility at any time.
Your main track record is your personal QUSHi performance record outside separate competitions. QUSHi may offer a reset feature called The Comeback, which lets you reset your main track record. The Comeback resets only your main track record. It does not reset, alter, or remove your results, standings, or history in Cash Games, private leagues, public leagues, or other competitions, which are recorded separately.
The Comeback may be a paid feature, and resets may be limited in number or frequency. We may retain records of resets and prior simulated activity internally as needed to preserve competitive integrity, prevent manipulation, detect fraud, resolve disputes, and comply with law.
QUSHi may allow users to join, create, manage, or participate in public, private, school, and club leagues, Cash Games, and other competitions. League results may be separate from a user’s main QUSHi record or leaderboard ranking, depending on the feature and league rules.
League creators are responsible for the names, descriptions, settings, invitations, and content they submit. League creators may not use QUSHi to run illegal promotions, paid entry competitions, gambling, wagering, raffles, lotteries, side bets, securities offerings, or any activity that violates these Terms or applicable law.
Unless QUSHi clearly identifies itself as the sponsor of a specific league, competition, promotion, or prize, QUSHi is not responsible for user-created prizes, promises, rewards, recognition, or payments offered by league creators or other users.
From time to time, QUSHi may offer skill-based Cash Games and prize competitions in which eligible users can win prizes based on simulated trading performance. No purchase, payment, or entry fee is ever required to enter or to win, and a purchase will not improve your chances of winning. Winners are determined by skill, meaning performance is measured against the objective criteria published for each competition, and not by chance.
Each competition is governed by separate Official Rules, which control in the event of any conflict with these Terms and which set out eligibility, how to enter, the prize and its value, how and when winners are selected, and any restrictions. Competitions are void where prohibited.
Unless the applicable Official Rules state otherwise, Cash Games and real cash prize competitions are open only to legal residents of the United States who are at least 18 years old at the time of entry and who satisfy all eligibility, verification, and location requirements. Residents of the European Union, European Economic Area, United Kingdom, and other international territories are not eligible to enter Cash Games or win real cash prizes unless the applicable Official Rules expressly permit their participation.
Cash Games and prize competitions require date-of-birth verification at entry and may require identity, location, tax, affidavit, release, or other eligibility verification before a prize is awarded or paid.
Attempting to falsify age, identity, residence, or location information, including through a VPN, proxy, geolocation spoofing, false account information, duplicate accounts, or other circumvention method, may result in disqualification, prize forfeiture, account suspension or termination, and loss of access to related competition features.
We may disqualify users, withhold prizes, revise results, or cancel a competition if we believe there has been fraud, abuse, manipulation, technical error, ineligible participation, circumvention of regional restrictions, or a violation of the Official Rules or these Terms. You are responsible for all taxes and reporting obligations on prizes you receive unless the Official Rules state otherwise.
To receive a cash prize through a third-party payout service, you must meet that service’s eligibility requirements, including any minimum age. We may substitute, modify, or cancel prizes where permitted by law and the applicable Official Rules.
QUSHi does not permit gambling, wagering, betting, paid entry competitions, lotteries, raffles, or games of chance. You may not require or request payment, purchase, consideration, deposit, crypto, virtual currency, token, gift, tip, side bet, or anything of value as a condition to join a league, participate in a competition, or become eligible for a prize.
You may not use QUSHi to facilitate illegal gaming, gambling, wagering, financial schemes, market manipulation, fraud, or unlawful promotions.
Tutorials, videos, posts, charts, comments, market commentary, and other content on QUSHi are for educational and informational purposes only. They do not constitute investment, financial, trading, legal, accounting, or tax advice, or a recommendation to buy, sell, hold, short, cover, or trade any asset in the real world.
You are solely responsible for any decisions you make outside QUSHi. Consult a qualified, licensed professional before making any real-world financial decision.
You agree not to misuse QUSHi. You may not:
We may investigate violations and may remove content, restrict features, reset performance, disqualify users, suspend or terminate accounts, or take other action at our discretion.
You retain ownership of content you submit, such as posts, comments, profile information, images, videos, and league descriptions. By submitting content, you grant QUSHi a worldwide, nonexclusive, royalty-free, sublicensable, transferable license to host, store, copy, display, reproduce, publish, distribute, modify, adapt, reformat, create derivative works from, and otherwise use your content to operate, provide, improve, promote, and protect the Service. This license continues for as long as reasonably necessary for those purposes, including for backups, moderation, safety, legal compliance, and dispute resolution.
You represent that you have all rights necessary to submit your content and grant this license, and you may not submit content that infringes or violates the rights of others. We may remove, limit, or refuse to display any content at any time.
Some QUSHi features are visible to other logged-in users, including profiles, posts, comments, leaderboards, league pages, records, rankings, badges, followers, fans, handles, and certain simulated trading information. Certain leagues may make portfolios, holdings, trade history, or performance visible during or after a competition, depending on the league settings.
You are responsible for reviewing visibility settings and understanding what may be shown to others before joining a league, posting content, or using public features.
The Service, including the QUSHi name, logos, badges, designs, code, software, interfaces, graphics, text, videos, charting engine, exchange simulation, databases, and other materials, is owned by QUSHi or its licensors and protected by intellectual property and other laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, publicly display or perform, create derivative works from, or otherwise exploit any part of the Service.
The QUSHi name, QUSHi logo, Q badge logo, and other QUSHi brand features are trademarks or registered trademarks of QUSHi, LLC. You may not use our name, logos, or other brand features without our prior written permission.
QUSHi retains all intellectual property rights in the Service, including all improvements, modifications, enhancements, and derivative works, regardless of whether they were inspired by or developed in response to user feedback. If you provide feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, without obligation or compensation to you.
Subject to these Terms, we grant you a limited, revocable, nontransferable, nonsublicensable, nonexclusive license to access and use QUSHi for personal, noncommercial, educational purposes. All rights not expressly granted are reserved. You may not use QUSHi in a way that violates these Terms, applicable law, app store rules, or third-party rights.
QUSHi may offer paid features, optional purchases, track record resets through The Comeback, or other paid products. Prices, features, billing, and cancellation terms will be shown before purchase where required, and you agree to pay all charges you authorize.
In-app purchases are processed through the Apple App Store or Google Play, as applicable, and are subject to the terms, payment rules, and refund rules of the applicable app store. Unless required by law or stated in a specific offer, payments are nonrefundable.
Paid features do not guarantee or improve leaderboard results, trading performance, competition results, followers, visibility, or prizes, and do not affect eligibility for or the outcome of any free, skill-based competition.
We process personal data as described in our Privacy Policy, which is incorporated into these Terms. Where required by law, we provide privacy rights and choices, which may include the right to access, delete, or correct personal information; opt out of sale or sharing; limit the use of sensitive personal information; appeal a privacy decision; or use an authorized agent. We use cookies and similar technologies. You can manage consent through the Cookie Preferences link or banner, where available.
California residents may have rights under the California Consumer Privacy Act, as amended, including rights related to sensitive personal information where applicable. You can submit privacy requests through account settings, help, or by contacting contact@qushi.io. We will confirm and process your request as required by law. We do not knowingly sell or share the personal information of users we know to be under 16 without affirmative authorization, except as required by law.
QUSHi may use or link to third-party services, including app stores, analytics providers, content delivery networks, data and charting providers, social platforms, identity verification vendors, payout providers, and external websites. We are not responsible for their content, services, data, availability, or practices. Your use of third-party services may be subject to their own terms and privacy policies.
QUSHi may be updated, interrupted, suspended, limited, or discontinued at any time. We may add, remove, modify, reset, or discontinue features, leagues, leaderboards, tutorials, virtual cash, virtual balances, QUSHi Coins, competitions, tools, pricing, content, or rankings at any time. We do not guarantee that QUSHi will always be available, uninterrupted, secure, accurate, or error-free.
Some QUSHi features may be experimental, beta, limited release, or test features. They may be changed, reset, removed, or discontinued at any time and may contain errors.
You may stop using QUSHi at any time. We may suspend, restrict, or terminate your access for any violation of these Terms, suspected fraud or abuse, legal requirement, or risk to users or the Service. After termination, your right to use QUSHi ends immediately.
Before you delete your account, you may request a copy of the personal information we hold about you. Account deletion is permanent. Once your account is deleted, we cannot recover or provide your information. We may limit or deny exports where necessary for security, fraud prevention, legal compliance, user privacy, technical limitations, competition integrity, or the protection of the Service.
When you delete your account, we delete or de-identify your personal data, except where we are required or permitted to retain it by law, for security or fraud prevention, to resolve disputes, to preserve competition integrity, or in routine backups that are overwritten in the ordinary course. Content you shared may continue to appear to other users if it was copied, shared, embedded, preserved for safety, included in another user’s activity, or retained where permitted by law.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, SECURITY, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE, OR THAT SIMULATED RESULTS, LEADERBOARD RESULTS, EDUCATIONAL CONTENT, OR PLATFORM METRICS WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR REAL WORLD DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUSHi AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100.
Nothing in these Terms limits liability that cannot be limited by law, including liability for our willful misconduct, gross negligence, or death or personal injury caused by our negligence. Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless QUSHi and its affiliates, officers, employees, contractors, agents, licensors, and service providers from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use or misuse of QUSHi, your content, your violation of these Terms or of any law or third party right, any league, competition, promotion, or prize you create or run, and your fraud, abuse, manipulation, or unauthorized activity. We may control the defense of any matter subject to indemnification, and you agree to cooperate.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
A. Informal resolution first. Before either you or QUSHi starts an arbitration or court proceeding, the party with the dispute must first send a written notice describing the dispute and the requested relief.
B. Mandatory binding arbitration. You and QUSHi agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of QUSHi will be settled by binding individual arbitration. This means you and QUSHi are each waiving the right to sue in court and to have a jury trial, except that either party may bring an individual claim in small claims court if the claim qualifies.
C. Arbitration administrator and rules. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules in effect when the claim is filed, as modified by these Terms. A single neutral arbitrator will resolve the dispute. If 25 or more similar demands are filed against QUSHi by or with the coordination of the same or related counsel, the AAA Mass Arbitration Supplementary Rules and their corresponding fee schedule will apply. If the AAA will not administer the arbitration in a manner consistent with these Terms, you and QUSHi will agree on another established arbitration provider, and if you cannot agree, a court of competent jurisdiction will appoint one.
D. Arbitration fees. Payment of filing, administrative, and arbitrator fees is governed by the AAA’s applicable rules and fee schedule. For an individual claim brought under the AAA Consumer Arbitration Rules, you are responsible only for the consumer filing fee set by the AAA, and QUSHi will pay the remaining AAA administrative fees and the arbitrator’s compensation. This allocation does not apply where the arbitrator finds that a claim was frivolous or filed for an improper purpose, in which case fees are allocated as permitted by the AAA rules and applicable law. Each party otherwise bears its own attorneys’ fees and costs unless a statute or the arbitrator’s award provides otherwise.
E. Individual capacity only and class action waiver. YOU AND QUSHi AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
F. 30-day right to opt out. You may opt out of the arbitration and class action waiver provisions in this Section. To opt out, send a written notice to contact@qushi.io with the subject line “Arbitration Opt Out” within 30 days of first creating your QUSHi account. Your notice must include your full name and the email address associated with your account. If you opt out of these provisions, QUSHi also will not be bound by them as to you. Opting out does not affect any other part of these Terms.
G. Governing law and venue. As specified in Section 27, these Terms are governed by the laws of the State of Florida. Any arbitration will be conducted in Hillsborough County, Florida, unless you and QUSHi agree otherwise.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. To the extent any dispute is not subject to arbitration, it must be brought exclusively in the state and federal courts located in or serving Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts. If you are a consumer and mandatory law in your place of residence gives you rights that cannot be waived, nothing in these Terms limits those rights.
We respect intellectual property rights and respond to clear notices of alleged copyright infringement. If you believe content on QUSHi infringes your copyright, send a notice to our designated agent:

Your notice should include your contact information, identification of the copyrighted work, identification of the allegedly infringing material and its location, a statement of good faith belief that the use is unauthorized, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your physical or electronic signature. We may remove allegedly infringing content and terminate repeat infringers.
If you download QUSHi from the Apple App Store or Google Play, you also agree to the applicable store’s terms. These Terms are between you and QUSHi only, not Apple or Google. Apple and Google have no obligation to provide maintenance or support for the App.
To the extent permitted by law, Apple and Google are not responsible for the App or any claims relating to it, including product liability, regulatory compliance, or intellectual property claims. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you.
You may not use QUSHi if you are located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive US sanctions, or if you are on any US list of prohibited or restricted parties. You agree not to use QUSHi in violation of any export control, sanctions, or trade laws.
If any part of these Terms is found invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remaining parts will remain in full effect.
If we do not enforce a provision of these Terms, that does not waive our right to enforce it later.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, sale of assets, reorganization, change of control, or by operation of law.
These Terms, the Privacy Policy, any official competition rules, and any additional terms we provide for specific features are the entire agreement between you and QUSHi regarding the Service.
