QUSHi Privacy Policy

QUSHi is operated by QUSHi, LLC, a Florida limited liability company. In this Privacy Policy, “QUSHi,” “we,” “us,” and “our” mean QUSHi, LLC. For users in the EU, EEA, and UK, QUSHi, LLC is the controller of the personal data described in this Privacy Policy.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use QUSHi, including our website, mobile app, simulated trading tools, virtual cash and virtual balances, QUSHi Coins, The Comeback, leaderboards, league play, Cash Games, competitions, community features, educational content, profiles, posts, charts, and related services.

QUSHi is a simulated trading, education, and community platform. QUSHi is not a bank and does not provide real money trading, brokerage services, trade execution, investment advice, financial advice, legal advice, tax advice, custody, banking, deposit accounts, or financial accounts. Any in-app feature names are product labels for simulated, entertainment, and educational functions only.

1. Scope

This Privacy Policy applies to personal information we collect through QUSHi, including when you visit our website, create an account, use the mobile app, place simulated trades, join leagues, enter Cash Games or prize competitions, post content, interact with other users, contact support, or use any related feature. It applies to users in the United States, the EU, the EEA, and the United Kingdom.

Some features may have additional privacy notices, competition rules, eligibility screens, or feature-specific disclosures. If a feature-specific notice conflicts with this Privacy Policy, the feature-specific notice controls for that feature.

This Privacy Policy works together with our Terms of Service.

Contract. We process personal information when necessary to provide QUSHi, manage accounts, provide simulated trading, operate leagues, process purchases, provide support, and enforce the Terms.

Legitimate interests. We process personal information for our legitimate interests, including operating and improving QUSHi, protecting the Service, preventing fraud and abuse, moderating content, securing accounts, measuring performance, developing features, and communicating with users. Consent. We rely on consent where required, such as for certain cookies, analytics, marketing, push notifications, or other optional features. You may withdraw consent at any time.

Legal obligation. We process personal information when necessary to comply with laws, tax obligations, competition rules, lawful requests, fraud-prevention requirements, age and eligibility rules, and recordkeeping requirements.

6. Public Features and Visibility

QUSHi is a community platform. Information you provide or generate may be visible to other logged-in QUSHi users depending on the feature, your settings, and league settings. This may include your handle, profile photo, bio, posts, comments, charts, follows, fans, badges, rankings, leaderboard position, simulated performance, virtual portfolio information, holdings, open orders, closed trades, league participation, league results, and competition activity.

Certain leagues may make portfolios, holdings, trade history, performance, or other simulated activity visible during or after a competition. Public leagues may be visible to other logged-in QUSHi users. Private leagues may be visible to league members, organizers, administrators, or others allowed by the feature design.

Content visible to other users can be copied, screenshotted, cached, embedded, or shared by others outside our control. Even after you delete or hide content, copies may persist in backups, on other users’ devices, in another user’s activity, or in third-party caches for a period of time. Review your visibility settings before posting, joining a league, entering a competition, or using public features.

7. Skill-Based Cash Games, Prize Competitions, and Eligibility Verification

Skill-based Cash Games and prize competitions are free to enter, have no entry fee, and require no purchase. A purchase will not improve your chances of winning. Cash Games and prize competitions are open only to eligible users who are 18 or older and who satisfy the location and verification requirements in the applicable Official Rules. Unless the applicable Official Rules state otherwise, skill-based Cash Games and real cash prize competitions are limited to eligible legal residents of the United States.

Residents of the European Union, European Economic Area, United Kingdom, and other international territories are not eligible to enter Cash Games or win real cash prizes unless the applicable Official Rules expressly permit their participation.

We may collect and use personal information to confirm eligibility, prevent duplicate entries, enforce competition rules, process prizes, withhold or issue tax forms, verify identity, verify age, verify location, detect fraud, investigate manipulation, and comply with the law.

This may include legal name, date of birth, country, state, identity verification information, tax information, payment or payout information, affidavit or release information, device information, fraud prevention information, and eligibility-related location information. We collect date of birth at entry to confirm you are 18 or older, and we may require additional verification after the competition ends and before a prize is paid.

We may use verification and fraud prevention information to detect VPN use, proxy use, geolocation spoofing, duplicate accounts, false identity, false residence, false age information, or other attempts to bypass eligibility restrictions.

If you do not provide the required verification information, you may not be able to enter, remain in, appear on a roster for, win, or receive a prize from a Cash Game or prize competition.

8. Rewards, Referrals, and Incentives

QUSHi may offer rewards, virtual items, badges, QUSHi Coins, competition rewards, profile or activity rewards, and similar incentives, as well as referral or invite features. Participating in these may require us to process account, activity, competition, referral, invite, and eligibility information, including limited information about people you invite.

Rewards, QUSHi Coins, and virtual items have no cash value and are not redeemable for money except where separate official rules expressly provide otherwise.

9. The Comeback

QUSHi offers a paid in-app track record reset feature called The Comeback. The Comeback lets you reset your main track record and start over with a new virtual balance. Purchases of The Comeback are processed through the applicable app store, and we may receive related purchase records as described in Section 2.

The Comeback applies only to your main track record. When you reset, your main visible record starts over: your performance chart start date, your visible statistics, and your simulated balance begin again from the reset point. Competitions, including Cash Games, private leagues, and public leagues, each have their own separate record and leaderboard, and The Comeback does not affect them.

We retain records of resets and your prior simulated activity internally, as needed, to operate QUSHi, preserve competitive integrity, prevent manipulation, detect fraud, resolve disputes, and comply with the law. The Comeback does not delete your account or personal information, nor does it erase records we are required or permitted to keep.

10. Cookies, Analytics, Advertising, and Similar Technologies

We use essential technologies to provide QUSHi, keep accounts secure, remember settings, process logins, and operate core features. These remain active because they are necessary for QUSHi to function.

Where permitted by law and your choices, we use analytics, measurement, attribution, advertising, marketing, and personalization technologies to understand usage, improve QUSHi, and measure campaigns. You can manage these through Cookie Preferences, where available, and through your device settings for certain mobile tracking or advertising choices.

Where required by law, we honor recognized opt-out preference signals, including Global Privacy Control.

11. App Permissions and Push Notifications

The QUSHi mobile app may request device permissions, such as notifications, photos, camera, or storage, depending on the feature. We access permission-based information only when you grant permission or use the related feature. You may manage permissions through your device settings.

If you allow push notifications, we may send account alerts, league and competition updates, educational reminders, social activity notices, and other QUSHi messages. You may turn off push notifications in your device settings.

We do not sell your personal information for money. We may share personal information with analytics, advertising, attribution, or marketing partners in ways that some laws may consider a sale, sharing, targeted advertising, or cross-context behavioral advertising.

Where required by law, you may opt out by using Cookie Preferences, privacy settings, the “Do Not Sell or Share My Personal Information” link, a recognized opt-out preference signal such as Global Privacy Control, or by contacting contact@qushi.io.

We do not knowingly sell or share the personal information of users under 16 without the affirmative authorization required by law.

You may opt out of marketing emails through the unsubscribe link or by contacting us. Even if you opt out of marketing, we may still send service, security, account, competition, legal, or transactional messages while you have an account.

14. Retention

We keep personal information only as long as reasonably necessary for the purposes in this Privacy Policy, then delete, deidentify, aggregate, or anonymize it where appropriate. Different categories are kept for different periods.

We may retain records longer where reasonably necessary for an ongoing dispute, claim, investigation, audit, legal hold, fraud review, tax matter, regulatory request, or enforcement action, until that matter is resolved.

We use reasonable technical, organizational, and administrative safeguards to protect personal information, including access controls, encryption, authentication, monitoring, vendor review, and logging. No system is completely secure. You are responsible for keeping your credentials confidential and notifying us if you believe your account has been accessed without authorization.

If a data breach affecting your personal information occurs, we will notify you and the relevant authorities, where required by law and within the timeframes set by law.

This section applies where required by California or other US state privacy laws.

We collect the categories of personal information described in this Privacy Policy, including identifiers, account information, internet or electronic network activity, commercial information, geolocation information, audio or visual content you provide, inferences, and sensitive personal information where applicable. We use and disclose these categories for the business and commercial purposes described above, and to the categories of recipients in Section 12.

We do not sell personal information for money. We may share personal information for targeted advertising or cross-context behavioral advertising, where permitted by law and your choices. You may opt out using Cookie Preferences, privacy settings, the “Do Not Sell or Share My Personal Information” link, Global Privacy Control where required by law, or by contacting contact@qushi.io.

We do not knowingly sell or share the personal information of users under 16 without affirmative authorization, except as required by law. We will not discriminate against you for exercising privacy rights, although some features may not work without the information needed to provide them.

California Shine the Light. California residents may request information about disclosures of personal information to third parties for those third parties’ direct marketing purposes.

18. Children and Teens

QUSHi is not intended for and is not directed to children under 13. Users under 13 may not create an account or use QUSHi, and we do not knowingly collect their personal information. This is consistent with the US Children’s Online Privacy Protection Act.

You must be at least 16 to create a standard QUSHi account, unless a higher minimum age is required where you live. If you are under the age of majority in your jurisdiction, you may use QUSHi only with the consent of a parent or legal guardian. You must be at least 18 to enter Cash Games, real cash prize competitions, or any feature involving real cash prizes.

We do not knowingly sell or share the personal information of any user under 16 without the affirmative authorization required by law. Where additional protections apply to minors’ data, we apply them as required.

If we learn that a user does not meet QUSHi’s age or eligibility requirements, we may block account creation, deny access, suspend or close the account, remove the user from competitions, withhold prizes, delete information, or take other action consistent with our Terms and applicable law. Parents or guardians may contact contact@qushi.io with privacy concerns involving a minor.

19. Automated Processing, Rankings, and Fraud Detection

QUSHi uses algorithms, automated systems, rules, and scoring to operate simulated trading, calculate leaderboards, rank users, assign badges, detect fraud, identify duplicate accounts, enforce competition rules, moderate activity, and protect the Service. These may affect visibility, rankings, eligibility, access to features, competition results, disqualification, or prize processing.

Prize disqualification, prize withholding, and Cash Game eligibility decisions may involve automated flags, but final prize-related decisions may be reviewed by QUSHi or its competition administrators. We do not make decisions producing legal or similarly significant effects about you based solely on automated processing without human involvement. Where required by law, you may request information about certain automated decisions or object to certain processing by contacting contact@qushi.io.

20. International Transfers

QUSHi is based in the United States. Your personal information may be processed in the United States and other countries where our service providers or we operate, which may have privacy laws that differ from those in your country.

Where required, we use appropriate safeguards for international transfers, such as the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Agreement or Addendum, adequacy decisions, transfer impact assessments, or other lawful mechanisms. QUSHi may link to or integrate third-party services, including app stores, identity verification vendors, analytics providers, advertising partners, charting tools, market data providers, social platforms, payout providers, and external websites. These operate under their own privacy policies, and we are not responsible for their practices.

22. Simulated Trading and Financial Disclaimer

Trading on QUSHi is simulated using virtual cash and virtual balances and does not involve real money or actual brokerage transactions. Performance metrics, leaderboards, and portfolios are simulated for educational and competitive purposes only. Do not rely on simulated performance as indicative of real-world or future results.

23. App Store and Mobile Disclosures

If you download QUSHi from the Apple App Store or Google Play, your use is also subject to those stores’ terms. The practices described here are intended to align with the privacy information we disclose in the app stores, including Apple’s App Tracking Transparency framework and Google Play’s Data Safety section.

24. Aggregated and Deidentified Data

We may create aggregated or deidentified data that does not identify you and use it for any lawful purpose, including analytics, research, and improving the Service. We will maintain such data in deidentified form, will not attempt to reidentify it except as permitted by law, and will require recipients to do the same where applicable.

25. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide reasonable notice via QUSHi, email, the app, or another reasonable method, and we will update the effective date above. The updated Privacy Policy is effective when posted or as otherwise stated in the notice.
